Please read these Terms of Service (“Terms”) carefully. They govern your access to and use of www.zelligcare.com (the “Site”), which is operated by Zellig Health LLC. Your use of the Site constitutes your agreement to these Terms. If you do not agree, do not use the Site. References to “Zellig” in these Terms refer to both Zellig Health LLC and Zellig Psychiatry PC as applicable.
Information on the Site is provided for general educational and informational purposes only. It is not medical advice, and it is not a substitute for evaluation, diagnosis, or treatment by a qualified health care professional. Reading, browsing, or otherwise interacting with the Site does not create a clinician-patient relationship between you and Zellig Psychiatry PC or any of its clinicians.
A clinician-patient relationship with Zellig Psychiatry PC is established only after (a) you complete the intake process, (b) you have executed the required consent forms, and (c) you have been accepted as a patient by one of our clinicians. Submitting a contact form, appointment request, or other inquiry through the Site does not, on its own, create a clinician-patient relationship, guarantee that you will be accepted as a patient, or guarantee a specific appointment date or time.
Never disregard professional medical advice or delay seeking it because of something you have read on the Site.
The Site is not for emergencies.
Medical or psychiatric emergency: Call 911 or go to the nearest emergency room.
Crisis or considering self-harm: Call or text 988 to reach the Suicide and Crisis Lifeline, or text HOME to 741741 to reach the Crisis Text Line.
Do not use Site forms, email, or other Site channels to communicate emergencies. We do not monitor these channels in real time, response is not guaranteed, and any response may be significantly delayed.
Consent to Electronic Communications
By using the Site or providing your contact information through Site forms, you consent to receive electronic communications from us. You agree that any agreements, notices, disclosures, or other communications we provide electronically satisfy any legal requirement that such communications be in writing.
Phone Calls and Text Messages
If you provide your phone number through a Site form, you agree that Zellig may contact you by phone, voicemail, or text message regarding your inquiry, scheduling, appointment reminders, billing, and other practice-related matters. Message and data rates may apply. Text messages are not encrypted and may be intercepted; you should consider this before transmitting sensitive information by text.
To stop receiving text messages, reply STOP to any message. To stop receiving marketing emails, follow the unsubscribe instructions in any marketing email. Opting out of marketing communications will not stop transactional messages related to your care or your account.
Analytics and Session Analysis
Google Analytics is used with IP anonymization enabled. We do not collect or transmit the contents of Site forms or any health-related information through it. You may opt out by installing the Google Analytics Opt-out Browser Add-on or enabling “Do Not Track” in your browser.
Microsoft Clarity captures session recordings, mouse movements, clicks, and scrolling behavior. Clarity masks form field text by default. You may opt out via “Do Not Track” browser settings or privacy tools that block third-party tracking scripts.
Privacy and Protected Health Information
Information you submit through the Site is governed by our Privacy Policy. Once you become a patient, information about your care is Protected Health Information (PHI) governed by our Notice of Privacy Practices under the Health Insurance Portability and Accountability Act, the Pennsylvania Mental Health Procedures Act, and other applicable laws.
Zellig Psychiatry PC is licensed to provide clinical services only to patients located in Pennsylvania. The Site is intended for visitors located in Pennsylvania and is not directed at residents of other states or countries. We do not offer clinical services to non-Pennsylvania residents.
The Site is not directed at children under thirteen, and we do not knowingly collect personal information from children under thirteen through the Site. Zellig Psychiatry PC provides clinical services to patients age twelve and older, but intake for minor patients is conducted through our patient portal with parent or legal guardian involvement, not through the Site.
You are granted a non-exclusive, non-transferable, revocable license to access and use the Site for lawful, personal, informational purposes. You agree not to:
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms.
All content on the Site — including text, graphics, logos, images, audio, video, design elements, and software — is owned by Zellig Health LLC, Zellig Psychiatry PC, or our licensors, and is protected by United States and international copyright, trademark, and other intellectual property laws. The Zellig name and logo are trademarks. Nothing in these Terms grants you any right or license to use any of our trademarks, trade names, or content except as expressly authorized.
The Site may contain links to third-party websites. These links are provided for convenience only. We do not control these sites, do not endorse their content, and are not responsible for their privacy practices, content, or availability. Your use of any linked site is at your own risk and subject to that site’s own terms and policies.
You agree to indemnify, defend, and hold harmless Zellig Health LLC, Zellig Psychiatry PC, and their respective officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Site, (b) your violation of these Terms, or (c) your violation of any third-party right, including intellectual property or privacy rights.
Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration will be conducted in Pennsylvania, and judgment on the arbitrator’s award may be entered in any court of competent jurisdiction. This arbitration provision does not apply to claims that, under applicable law, cannot be subject to mandatory arbitration — including, where applicable, claims arising from the provision of medical services by Zellig Psychiatry PC to established patients.
Class Action Waiver
You agree to bring any dispute against us only in your individual capacity. You waive any right to participate in a class action, collective action, or representative proceeding against us.
Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles. To the extent any dispute is not subject to arbitration, the dispute will be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to personal jurisdiction and venue there.
We may modify these Terms at any time. The Effective Date at the top of this page indicates when the Terms were last revised. Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you should stop using the Site.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
